Demand a Helmet While Buying a Bike..!

Did you know that when you buy a two-wheeler you need to purchase a helmet too? The Central Motor Vehicle Rules states so. But not many vehicle dealers and customers seem to be aware of this.

According to Section 138 (4) (F) of the Central Motor Vehicles Rules, at the time of purchase of the two-wheeler, the manufacturer of the two-wheeler shall supply protective headgear conforming to specifications prescribed by the Bureau of Indian Standards under the Bureau of Indian Standards Act, 1986.

“On Tuesday, my brother purchased a two-wheeler from a dealer in Villivakkam. When I demanded a helmet, the staff in the shop said that they have not received any government order or from the manufacturer. The cost of the helmet should be added to the price of the vehicle,” said V. Suresh, an advocate. (Email id vssureshsouli@gmail.com)

He demanded that Regional Transport Officers conduct a surprise inspection of all the automobile dealers in the city. “It is not sufficient if they penalise motorists for not wearing helmets, they should also take action against dealers who do not provide headgear,” said the advocate.

Similar is the experience of P. Ashok, a resident of Chetpet, Chennai who purchased a bike from a dealer in Valsaravakkam recently. 

“I did not receive a helmet. In fact, I did not even know there was such a rule. I would have demanded it from him had I known about it,” he said.
An automobile dealer in Valsaravakkam said that they do provide helmet for a cost only when the customer asks for it. “We have not got any instruction from the manufacturer to provide the helmet along with the vehicle,” said the dealer.
Senior transport officials said they do check if dealers have provided the headgear as it is mandatory while registering a two-wheeler. “Most often, it is the employees of the dealer who come to us. They merely show us the bill and claim they have provided it. We may now have to inspect all the automobile outlets in the city,” said an RTO.
