I had a bank surety for my relation for Rs. 1
lakh. The relation did not repay the loan. The bank sent a notice. The had
settled the Balance amount Rs. 80,000. Any possible I get the amount from my
relation?
Answer:
You can pursue both civil & criminal
remedy . You
can give a criminal complaint with all the material proof to show that you paid
for your relation and take criminal action for the offence of cheating if you
want to punish him.
To recover the money that you paid for your
relation, you have to file a suit (Case) for recovery of money. before filing
of money suit, you should have the proof to show that you have paid the money
for your relation.
If it is so, a mandatory notice has to be sent
& if your relation fails to pay the amount after receipt of the notice, you
can file a civil case.
